PRODUCT COMPATIBILITY, LIMITATION, AND INSTALLATION NOTES. . BUYER'S RESPONSIBILITY TO VALIDATE TERMS AND CONDITIONS OF LIMITED LIFETIME REPLACEMENT WARRANTY AND LIMITED COMPATIBILITY GUARANTEE. . ACTIONS OR CONDITIONS WHICH VOID LIMITED LIFETIME REPLACEMENT WARRANTY AND LIMITED COMPATIBILITY GUARANTEE: . . LIMITATION/COMPATIBILITY NOTES: Note that it is a known limitation that all DDR400 mainboards on the market only Guarantee stability with a maximum of 2 DDR RAM banks (1 DIMM if double-sided). This is because DDR400 taxes the memory registers to a much greater degree than slower DDR RAM. DDR333 mainboards Guarantee stability with a maximum of 4 DDR RAM banks (2 DIMMs), and DDR266 mainboards Guarantee stability with a maximum of 6 DDR RAM banks (3 DIMMs). This is a memory register limitation and our Guarantee of operability should not be construed to mean that the RAM we sell can circumvent this memory register limitation. No RAM manufactured can circumvent these limitations reliably, and no advertisement making any such Guarantee should be believed by buyers. EXCEPTION: Dual-Channel Mainboards do allow the user to exceed these limitations when manufacturer's instructions are carefully followed. . . INSTALLATION NOTES: All DDR RAM buyers should note that INSTALLING DDR RAM IS USUALLY A VERY SIMPLE PROCESS, but it is not always a completely plug-and-play experience as was more commonly the case with pre-DDR SDRAM. In a few cases (about 5 percent of the time), a very simple BIOS update is required and/or a few simple manual adjustments need to be made to a few settings in the buyer's mainboard BIOS in order to boot with the new RAM or in order for your system to run with total stability. This is more frequently an issue with the faster DDR (DDR400, etc.) and less frequently an issue with standard speeds (DDR200, 266). . . In the very few cases where these simple updates/adjustments are necessary, they can be EASILY PERFORMED BY ANY BUYER who possesses even a modicum of technical expertise. However, buyers of any level of experience who are uncomfortable with performing these simple adjustments should remember that they are in fact attempting to perform an installation or upgrade function normally performed by technicians, and they should seek qualified assistance if they feel unsure of their ability. (This may often be nothing more than the help of a knowledgeable friend.) In these few cases, the seller will provide detailed e-mail technical support to the buyer, with regard to where to find BIOS update information/instructions, and as to specific recommended BIOS settings. The seller cannot and will not be responsible for the buyer's inability or refusal to follow seller's technical instructions, or the buyer's inability or failure to provide the seller with sufficient information for the seller to properly advise the buyer on how install the product. Although MOST INSTALLATIONS will NOT REQUIRE a BIOS UPDATE, BUYERS SHOULD NONETHELESS ASSUME THAT THEIR SYSTEM WILL BE ONE OF THE FEW WHICH REQUIRES THAT THIS UPDATE SHOULD BE DONE AND SHOULD NOT BID IF THEY ARE UNWILLING TO PERFORM THIS REQUIRED UPDATE. In no case whatsoever will the inability or refusal of a buyer to follow seller's technical advice, or provide proper technical information to the seller, be considered grounds for any type of refund or other adjustment. Nor will it ever justify a conclusion by any party that the product is defective or incompatible. Buyers understand and agree that only the seller, and no other person, may deem the product to be defective or incompatible. . . PRODUCT REPLACEMENT UNDER WARRANTY: If an incompatibility or inability to operate the product exists after buyers have performed all updates/adjustments as instructed by seller and deemed reasonable by the seller, and after buyers have provided all information requested by the seller, the seller will then authorize the return of the RAM from the buyer for the purpose of PROMPT REPLACEMENT (but never refund) of the affected RAM after testing of the returned item to assist the seller in best determining which specific model to supply to the buyer for greatest likelihood of success in installation. In no case whatsoever shall there be a refund but rather only replacement. Buyers who refuse to cooperate with seller's technical assistance and/or refuse to make needed BIOS updates/adjustments as advised by seller immediately VOID all product warranties, and immediately VOID all Guarantees of compatibility, and immediately VOID all rights to replacement of the product. ANY ATTEMPT to OVERCLOCK the DIMMs, whether INTENTIONAL or ACCIDENTAL, VOIDS ALL WARRANTIES. DO NOT EVER OPERATE RAM AT HIGHER THAN RATED FREQUENCIES OR VOLTAGES. ANY USE OF HEAT SPREADERS OR SIMILAR DEVICES IS CONSIDERED PROOF OF OVERCLOCKING AND VOIDS ALL WARRANTIES. (Heat spreaders are NEVER necessary when running RAM at rated speeds and voltages.) Damage to RAM due to overclocking/overvoltage can be detected under magnified visual inspection, and also frequently in our test bench, and will not be replaced. . . LIMITED LIFETIME REPLACEMENT WARRANTY is Limited to replacement for reason of defect only, and valid for the normal Lifetime of the product, always at least 3 years from date of purchase, and specifically defined as the lesser of 3 years or the minimum required by law in the state of jurisdiction of the purchaser. Entire Warranty is VOID in any instance where the product has been damaged by actions of the user or by the equipment in which the product was operated, whether accidental or intentional. Any overvoltage or operation of the product beyond its designed MHz clock speed specifications constitutes OVERCLOCKING which entirely VOIDS this Warranty. Use of a heat spreader or any other type of heat dissipation device on the RAM is considered proof of overclocking and VOIDS this Warranty. Limited Lifetime replacement Warranty is VOIDED by any tampering, damage, or removal of attached inventory control tag(s) on the DIMM, or any evidence on those tags of the previous attachment of a heat-dissipating device to the DIMM. . . Entire Warranty is NULL and VOID where any term or condition herein is prohibited by law, and no Warranty coverage shall then exist. Warranty is for replacement only and never for refund or provision of any other item of value. Replacement will be made with the most similar product reasonably available on the market at the time of replacement, and no Guarantee is expressed or implied that brand and/or model number and/or exact specifications will be identically matched. Warranty is VOID in the event that replacement products are no longer manufactured or not reasonably obtainable by the seller. Warranty is VOID outside of the United States and its Territories. All Warranty claims must be made by purchaser by means of return of the actual defective product along with proof of original purchase. If return is made more than 30 days after the purchase of the item, purchaser must include with the returned item a money order or other certified funds payment made payable to the seller in the amount of $14.50 to cover seller’s testing of returned item and replacement item, as well as return shipping, packaging, and insurance. Returned items which test fully functional by seller shall be returned to buyer at buyer’s expense. Any disputes over terms and conditions of this Warranty shall be interpreted by seller, with seller’s decision binding in all cases. . . LIMITED COMPATIBILITY GUARANTEE is a Limited Guarantee that this product will function in any mainboard designed to operate this exact type, size, and speed of DIMM, and is capable of operating at this DIMMs rated specifications. In addition, it is a Limited Guarantee that this product will operate in such a mainboard at the same time as any other DIMM of any brand, so long as the specifications of the other DIMM shall be identical to those of the DIMM purchased herein, and so long as the use of both DIMMs does not exceed the recommendations for maximum RAM allowed, as made by manufacturers of the mainboard, or any installed DIMM.. . . Exceptions to this Guarantee include situations where the buyer’s mainboard does not have a BIOS which can be updated, or the manufacturer has not released timely BIOS updates to enable the mainboard to function with the broadest range of the newest DDR RAM. Additionally excepted is any situation where the seller believes that buyer’s mainboard or other installed DIMM(s) are defective, or of insufficient manufactured quality to perform as advertised. Any claims of incompatibility must be made by buyer to seller via e-mail, and seller will instruct buyer on how to return the product for replacement after seller has requested and received system-specific information from buyer, and has instructed buyer in additional setup procedures which will almost always include the requirement that buyer perform update to mainboard BIOS, and may include instructions on setting up the BIOS to properly operate the RAM. Any disputes over terms and conditions of this Warranty shall be interpreted by seller, with seller’s decision binding in all cases. As shown above, buyer’s refusal to cooperate with seller’s technical support efforts, or requirements to update or modify BIOS, shall VOID this Limited compatibility Guarantee and the Limited Lifetime Warranty, in their entirety. . . INVENTORY / TAMPER CONTROL TAGS: The RAM you will be shipped contains inventory control tags attached by the seller and by the manufacturer. These tags are intended to indicate tampering or removal of the tag, and to indicate any use of heat spreaders. Any removal or damage to inventory control tags immediately voids the Limited Lifetime Warranty and Limited Compatibility Guarantee. .
